These Terms constitute a legally binding agreement between you (“Seller” or “Consignor”) and Designer Kids Club Ltd (“DKC”, “we”, “us”, or “our”) governing the consignment of items (“Items”) to DKC for listing, sale and fulfilment via our platform and services.
1. Acceptance of Terms
1.1 By submitting an Item to DKC and/or entering into the consignment process, you accept these Terms. If you do not agree, you must not send Items to us or consign them.
1.2 These Terms apply in conjunction with our general Website Terms of Use and Privacy Policy, which are incorporated by reference and available at [insert link].
1.3 We may revise or update these Terms from time to time. Changes will be effective upon posting on our website. Your continued use following publication constitutes acceptance of the revised Terms.
2. Definitions
- Consignment – the service by which you send Items to DKC, we receive, inspect, list, market and sell the Items on your behalf.
- Listing – the listing created by DKC for the Item on our platform, including photography, description, price, etc.
- Sale – the successful transaction by which a Buyer purchases your Item.
- Net Proceeds – the sale price of your Item minus DKC’s commissions, fees, and any costs or deductions as set out in these Terms.
- Service Period – the period during which DKC holds your Item and offers it for sale under the consignment arrangement.
- Reserve Price – the minimum price at which you agree the Item may be sold (if applicable), as agreed with DKC in writing.
3. Your Role & Warranties
3.1 You warrant and represent that you are the lawful sole owner of the Item (or are fully authorised to consign it) and that no third-party has any legal claim over it.
3.2 You warrant the Item is authentic, not counterfeit, free from undisclosed damage or defects, safe for resale, and complies with all applicable laws, regulations and resale standards (including but not limited to consumer goods safety, import/export, brand resale restrictions).
3.3 You will provide, on request, any proof of purchase, provenance, authenticity certificate or documentation we reasonably require.
3.4 You agree not to consign Items that:
- were made for or sold exclusively to employees of a brand, prototypes, press samples or one-off promotional pieces not intended for public resale;
- are prohibited from resale by the original brand or manufacturer;
- are unsafe, stolen, or subject to recall or embargo;
- contain materials or fur not permitted under applicable law or brand policy.
4. Delivery of Items to DKC
4.1 You are responsible for preparing and sending the Item to DKC using our approved consignment procedure. You must package the Item securely, include any required documentation, and send to the address we specify.
4.2 Risk of loss or damage remains with you until DKC acknowledges safe receipt of the Item and logs it into our system. At that point, we assume responsibility for storage (subject to the deductions described herein).
4.3 Standard inbound shipping arranged through the DKC consignment and rental return service includes insurance cover up to one hundred and fifty pounds when using Royal Mail Tracked 24.
If the value of your item is higher than the included cover, you must either:
· Purchase an enhanced delivery option with higher insurance through DKC before returning the item, or
· Arrange your own insured and tracked return service (such as Royal Mail Special Delivery)
4.4 DKC accepts no responsibility for loss or damage in transit beyond the insured value selected. If sufficient insurance has not been arranged by you, any compensation will be limited to the standard cover included with the selected return method.
4.5 Responsibility for the item remains with you until the parcel is scanned by the carrier and accepted into their network.
4.6 This does not affect your statutory rights.
5. Inspection, Authentication & Processing by DKC
5.1 Upon receipt, we will inspect the Item for condition, authenticity, completeness, conformity with the description you provided, and our listing standards.
5.2 We reserve the right to accept or reject any Item in our sole discretion. If we reject an Item, we will notify you and you may either arrange for these to be returned back to you (at your cost) or allow us to dispose of the Item (in accordance with clause 11).
5.3 We will grade the Item’s condition based on our internal condition scale, determine its listing strategy, and decide whether any refurbishment, cleaning or repair is required (such costs may be deducted from your payout if you have consented).
5.4 You grant us the right to photograph, describe and list the Item; you will not create or publish your own listing for that Item on any other platform before or during the Service Period.
5.5 You will be charged an Authentication fee of £10 for any items valued at more than £100.
5A.1 Right to Reject Items
DKC reserves the right to refuse, de-list, or remove any Item at any time before sale if, in our sole discretion, the Item:
• Fails authentication
• Differs materially from the condition or description provided
• Does not meet DKC quality, safety or hygiene standards
• Is damaged, defective, incomplete, or materially worn
• Contains counterfeit components or presents risk of brand infringement
• Breaches applicable laws, resale restrictions or brand policies
• Is deemed unsuitable for commercial or community standards
5A.2 Notification & Seller Response
If DKC rejects an Item, we will notify you by email.
You must respond within 14 days confirming one of the following:
- Return the Item to you (shipping cost payable by you), or
- Approve donation to our “Give Back” charity channel, or
- Approve responsible recycling/disposal
5A.3 Condition Downgrade & Pricing Adjustment
If an Item is accepted but found to be in a lower condition than stated, or requires repair/cleaning:
• DKC may downgrade the condition grade
• DKC may amend the listing price accordingly
• You will be notified and have 48 hours to request the Item back
(return costs apply)
If you do not respond within 48 hours, the amended listing will stand.
5A.4 Unclaimed Items
If you fail to respond to a rejection notice within 14 days, DKC may, at its discretion:
• Return the Item at your cost, or
• Donate the Item to a circular charity partner, or
• Responsibly recycle or dispose of the Item
No compensation will be payable in these circumstances.
5A.5 Counterfeit / Illegal / Unsafe Items
If we determine or reasonably suspect an Item is counterfeit, stolen, unsafe or in violation of law:
• The Item may be retained and destroyed or surrendered to authorities
• You will not receive compensation for the Item
• You may be charged authentication, handling and investigation fees
• You may be permanently barred from using DKC
5A.6 Early Return Requests
If you request an Item to be returned before the end of the Service Period (180 days):
• You may do so subject to return shipping and handling fees
• A reasonable administration and storage fee may also apply
6. Listing, Pricing & Marketing
6.1 DKC retains full control over the Listing: we will determine the final description, condition grade, imagery, pricing recommendation or reserve, timing and marketing approach (including special promotions, discounts, campaigns).
6.2 We may discuss and suggest pricing, reserve price or discount strategy with you, but the final decision rests with DKC. You agree to collaborate in good faith.
6.3 We may offer special “Make Offer” functionality, campaigns, price drops or flash sales at our discretion.
6.4 The Item will remain listed for the Service Period unless sold earlier, returned to you (see clause 11) or otherwise removed in accordance with these Terms.
6A. Service Period
6A.1 The initial Service Period during which DKC will list and offer your Item for sale is 180 days (6 months) from the date the Item first goes live on the Platform, unless otherwise agreed in writing.
6A.2 DKC may, in its sole discretion, extend the Service Period where:
• the Item is seasonal, or
• is generating Buyer interest, or
• is part of an active marketing promotion or live-sell event.
6A.3 If the Item remains unsold at the end of the Service Period, DKC will notify you and request written instructions within 14 days. You may choose to:
• reduce the price and continue the listing
• request return of the Item (return shipping costs apply)
• approve donation via our Give Back programme
6A.4 If you do not respond within 14 days, DKC may:
• apply progressive discounting and re-list the Item, or
• donate or responsibly recycle the Item.
7. Sale, Fulfilment & Transfer of Ownership
7.1 When a Buyer purchases your Item, ownership of the Item transfers to the Buyer only when we dispatch the Item and the Buyer’s payment and any inspection/return period (if applicable) has passed in accordance with our policy.
7.2 DKC will handle all outward shipping, fulfilment, Buyer communication and any returns or re-listing process in accordance with our Returns Policy.
7.3 If the Buyer exercises a return or a claim is made (for example on authenticity or condition) we will follow our Returns / Dispute process and you agree to cooperate, including by refunding, re-listing or replacing the Item if required.
8. Fees, Commissions & Payment to You
8.1 Net Proceeds
You will receive Net Proceeds, which are the Item sale price minus:
• DKC Commission (per the Fee Schedule Appendix)
• Authentication fee of £10 for any items valued at more than £100
• Any postage or agreed processing, cleaning, or repair costs
• Any promotional costs agreed with you (if applicable)
• Any return or chargeback deductions (if applicable)
8.2 Payout Triggers
A payout is only initiated once:
• The Buyer payment is fully cleared, and
• The Buyer return / inspection window has expired without dispute
(Default return decision period: 14 days from Buyer delivery)
8.3 Payout Timing
Payout processing:
- Begins 14 days after Buyer delivery
- Typical funds release within 1-3 business days thereafter
Estimated total payout time: 15-18 days post-delivery
(subject to no returns, disputes, or fraud holds)
8.4 Payout Method
Payouts are made to the Seller’s chosen method:
• Bank transfer (UK Faster Payments)
• Store Credit (if opted-in; may receive increased payout %)
8.5 Dispute / Fraud Holds
Payments may be temporarily withheld if:
• A return, chargeback, or authenticity claim is active
• The transaction is flagged by fraud prevention or AML checks
• Your account requires additional verification
You will be notified of any hold and reason.
8.6 Minimum Payout Threshold
A minimum balance of £10 in Net Proceeds is required before payout.
Lower amounts remain as pending balance until threshold reached.
8.7 Seller Verification Requirement (KYC)
Prior to payout release, DKC may require identity checks (KYC) to comply with financial regulations. Failure to comply may delay payouts.
8.8 The current fee schedule is set out in the our commission guide which we may change from time to time (see clause 2). We will notify you of any change at least [ 30 days ] prior to effect.
9. Authenticity, Returns & Buyer Claims
9.1 If after sale, a Buyer claims the Item is mis-described, counterfeit, damaged or otherwise materially not as represented, we reserve the right to investigate. If the claim is upheld:
- The sale may be cancelled;
- The Net Proceeds may be reversed;
- You may be required to refund DKC for any costs incurred (returns shipping, loss of value, disposal).
- 9.2 You agree to indemnify and hold DKC harmless against any loss, damage, claim or liability arising out of your breach of these Terms (for example, authenticity or provenance issues).
- 9.3 If we determine the Item to be counterfeit or non-authentic, we may (in our discretion):
- Return the Item to you (at your cost)
- Retain the Item for disposal
- Charge you a fee for handling and shipping as described in our policies.
10. Unsold Items / Re-listing / End of Service Period
10.1 If the Item has not sold during the Service Period, DKC may (in its discretion and after notifying you):
- Reduce the price and re-list
- Offer you the option to collect the Item (at your cost)
- Donate or otherwise dispose of the Item if you do not respond within [e.g., 14 days]
- 10.2 If you wish to end consignment early, you may request return of the Item; you may be liable for storage/handling fees and return shipping.
- 10.3 Storage, insurance and handling while the Item is consigned is at our facility; you may be charged storage fees after a specified free period.
11. Termination & Removal of Items
11.1 DKC may suspend or terminate this consignment arrangement (or your account) at any time if:
- You breach these Terms;
- We suspect fraud, mis-description or non-compliance;
- You consign prohibited Items;
- You fail to respond to our communications within [ specified time ].
- 11.2 Upon termination, any unsold Items will be returned to you (at your cost) or disposed of as previously agreed; any storage or return shipping fees become your responsibility.
- 11.3 Items that are counterfeit, unsafe or in violation may be removed immediately, and you will not have any claim against DKC for removal or disposal.
12. Limitation of Liability & Indemnities
12.1 To the fullest extent permitted by law, DKC’s liability to you under or arising out of the consignment arrangement shall be limited to your Net Proceeds from the sale of the Item.
12.2 You agree to indemnify, defend and hold harmless DKC (and its officers, directors, agents, employees) from and against any claims, losses or damages (including legal fees) arising from your breach of these Terms, your mis-description, your non-compliance with laws, or any claim relating to your Item.
12.3 Nothing in these Terms excludes liability for death or personal injury caused by negligence of DKC, or for any other liability which cannot be excluded by law.
13. Governing Law & Dispute Resolution
13.1 These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England & Wales.
13.2 The parties irrevocably agree to submit to the exclusive jurisdiction of the courts of England & Wales.
14. Miscellaneous
14.1 You may not assign or transfer your rights or obligations under these Terms without DKC’s prior written consent.
14.2 If any provision of these Terms is found invalid or unenforceable, the remainder shall continue in full force and effect.
14.3 These Terms, together with our general Website Terms of Use, Privacy Policy and any consignment agreement executed by you, constitute the entire agreement between you and DKC regarding consignment.
14.4 Notices to you may be given via email, whats app chat, over the phone or via your account dashboard.

These Terms constitute a legally binding agreement between you (“Seller” or “Consignor”) and Designer Kids Club Ltd (“DKC”, “we”, “us”, or “our”) governing the consignment of items (“Items”) to DKC for listing, sale and fulfilment via our platform and services.
1. Acceptance of Terms
1.1 By submitting an Item to DKC and/or entering into the consignment process, you accept these Terms. If you do not agree, you must not send Items to us or consign them.
1.2 These Terms apply in conjunction with our general Website Terms of Use and Privacy Policy, which are incorporated by reference and available at [insert link].
1.3 We may revise or update these Terms from time to time. Changes will be effective upon posting on our website. Your continued use following publication constitutes acceptance of the revised Terms.
2. Definitions
- Consignment – the service by which you send Items to DKC, we receive, inspect, list, market and sell the Items on your behalf.
- Listing – the listing created by DKC for the Item on our platform, including photography, description, price, etc.
- Sale – the successful transaction by which a Buyer purchases your Item.
- Net Proceeds – the sale price of your Item minus DKC’s commissions, fees, and any costs or deductions as set out in these Terms.
- Service Period – the period during which DKC holds your Item and offers it for sale under the consignment arrangement.
- Reserve Price – the minimum price at which you agree the Item may be sold (if applicable), as agreed with DKC in writing.
3. Your Role & Warranties
3.1 You warrant and represent that you are the lawful sole owner of the Item (or are fully authorised to consign it) and that no third-party has any legal claim over it.
3.2 You warrant the Item is authentic, not counterfeit, free from undisclosed damage or defects, safe for resale, and complies with all applicable laws, regulations and resale standards (including but not limited to consumer goods safety, import/export, brand resale restrictions).
3.3 You will provide, on request, any proof of purchase, provenance, authenticity certificate or documentation we reasonably require.
3.4 You agree not to consign Items that:
- were made for or sold exclusively to employees of a brand, prototypes, press samples or one-off promotional pieces not intended for public resale;
- are prohibited from resale by the original brand or manufacturer;
- are unsafe, stolen, or subject to recall or embargo;
- contain materials or fur not permitted under applicable law or brand policy.
4. Delivery of Items to DKC
4.1 You are responsible for preparing and sending the Item to DKC using our approved consignment procedure. You must package the Item securely, include any required documentation, and send to the address we specify.
4.2 Risk of loss or damage remains with you until DKC acknowledges safe receipt of the Item and logs it into our system. At that point, we assume responsibility for storage (subject to the deductions described herein).
4.3 Standard inbound shipping arranged through the DKC consignment and rental return service includes insurance cover up to one hundred and fifty pounds when using Royal Mail Tracked 24.
If the value of your item is higher than the included cover, you must either:
· Purchase an enhanced delivery option with higher insurance through DKC before returning the item, or
· Arrange your own insured and tracked return service (such as Royal Mail Special Delivery)
4.4 DKC accepts no responsibility for loss or damage in transit beyond the insured value selected. If sufficient insurance has not been arranged by you, any compensation will be limited to the standard cover included with the selected return method.
4.5 Responsibility for the item remains with you until the parcel is scanned by the carrier and accepted into their network.
4.6 This does not affect your statutory rights.
5. Inspection, Authentication & Processing by DKC
5.1 Upon receipt, we will inspect the Item for condition, authenticity, completeness, conformity with the description you provided, and our listing standards.
5.2 We reserve the right to accept or reject any Item in our sole discretion. If we reject an Item, we will notify you and you may either arrange for these to be returned back to you (at your cost) or allow us to dispose of the Item (in accordance with clause 11).
5.3 We will grade the Item’s condition based on our internal condition scale, determine its listing strategy, and decide whether any refurbishment, cleaning or repair is required (such costs may be deducted from your payout if you have consented).
5.4 You grant us the right to photograph, describe and list the Item; you will not create or publish your own listing for that Item on any other platform before or during the Service Period.
5.5 You will be charged an Authentication fee of £10 for any items valued at more than £100.
5A.1 Right to Reject Items
DKC reserves the right to refuse, de-list, or remove any Item at any time before sale if, in our sole discretion, the Item:
• Fails authentication
• Differs materially from the condition or description provided
• Does not meet DKC quality, safety or hygiene standards
• Is damaged, defective, incomplete, or materially worn
• Contains counterfeit components or presents risk of brand infringement
• Breaches applicable laws, resale restrictions or brand policies
• Is deemed unsuitable for commercial or community standards
5A.2 Notification & Seller Response
If DKC rejects an Item, we will notify you by email.
You must respond within 14 days confirming one of the following:
- Return the Item to you (shipping cost payable by you), or
- Approve donation to our “Give Back” charity channel, or
- Approve responsible recycling/disposal
5A.3 Condition Downgrade & Pricing Adjustment
If an Item is accepted but found to be in a lower condition than stated, or requires repair/cleaning:
• DKC may downgrade the condition grade
• DKC may amend the listing price accordingly
• You will be notified and have 48 hours to request the Item back
(return costs apply)
If you do not respond within 48 hours, the amended listing will stand.
5A.4 Unclaimed Items
If you fail to respond to a rejection notice within 14 days, DKC may, at its discretion:
• Return the Item at your cost, or
• Donate the Item to a circular charity partner, or
• Responsibly recycle or dispose of the Item
No compensation will be payable in these circumstances.
5A.5 Counterfeit / Illegal / Unsafe Items
If we determine or reasonably suspect an Item is counterfeit, stolen, unsafe or in violation of law:
• The Item may be retained and destroyed or surrendered to authorities
• You will not receive compensation for the Item
• You may be charged authentication, handling and investigation fees
• You may be permanently barred from using DKC
5A.6 Early Return Requests
If you request an Item to be returned before the end of the Service Period (180 days):
• You may do so subject to return shipping and handling fees
• A reasonable administration and storage fee may also apply
6. Listing, Pricing & Marketing
6.1 DKC retains full control over the Listing: we will determine the final description, condition grade, imagery, pricing recommendation or reserve, timing and marketing approach (including special promotions, discounts, campaigns).
6.2 We may discuss and suggest pricing, reserve price or discount strategy with you, but the final decision rests with DKC. You agree to collaborate in good faith.
6.3 We may offer special “Make Offer” functionality, campaigns, price drops or flash sales at our discretion.
6.4 The Item will remain listed for the Service Period unless sold earlier, returned to you (see clause 11) or otherwise removed in accordance with these Terms.
6A. Service Period
6A.1 The initial Service Period during which DKC will list and offer your Item for sale is 180 days (6 months) from the date the Item first goes live on the Platform, unless otherwise agreed in writing.
6A.2 DKC may, in its sole discretion, extend the Service Period where:
• the Item is seasonal, or
• is generating Buyer interest, or
• is part of an active marketing promotion or live-sell event.
6A.3 If the Item remains unsold at the end of the Service Period, DKC will notify you and request written instructions within 14 days. You may choose to:
• reduce the price and continue the listing
• request return of the Item (return shipping costs apply)
• approve donation via our Give Back programme
6A.4 If you do not respond within 14 days, DKC may:
• apply progressive discounting and re-list the Item, or
• donate or responsibly recycle the Item.
7. Sale, Fulfilment & Transfer of Ownership
7.1 When a Buyer purchases your Item, ownership of the Item transfers to the Buyer only when we dispatch the Item and the Buyer’s payment and any inspection/return period (if applicable) has passed in accordance with our policy.
7.2 DKC will handle all outward shipping, fulfilment, Buyer communication and any returns or re-listing process in accordance with our Returns Policy.
7.3 If the Buyer exercises a return or a claim is made (for example on authenticity or condition) we will follow our Returns / Dispute process and you agree to cooperate, including by refunding, re-listing or replacing the Item if required.
8. Fees, Commissions & Payment to You
8.1 Net Proceeds
You will receive Net Proceeds, which are the Item sale price minus:
• DKC Commission (per the Fee Schedule Appendix)
• Authentication fee of £10 for any items valued at more than £100
• Any postage or agreed processing, cleaning, or repair costs
• Any promotional costs agreed with you (if applicable)
• Any return or chargeback deductions (if applicable)
8.2 Payout Triggers
A payout is only initiated once:
• The Buyer payment is fully cleared, and
• The Buyer return / inspection window has expired without dispute
(Default return decision period: 14 days from Buyer delivery)
8.3 Payout Timing
Payout processing:
- Begins 14 days after Buyer delivery
- Typical funds release within 1-3 business days thereafter
Estimated total payout time: 15-18 days post-delivery
(subject to no returns, disputes, or fraud holds)
8.4 Payout Method
Payouts are made to the Seller’s chosen method:
• Bank transfer (UK Faster Payments)
• Store Credit (if opted-in; may receive increased payout %)
8.5 Dispute / Fraud Holds
Payments may be temporarily withheld if:
• A return, chargeback, or authenticity claim is active
• The transaction is flagged by fraud prevention or AML checks
• Your account requires additional verification
You will be notified of any hold and reason.
8.6 Minimum Payout Threshold
A minimum balance of £10 in Net Proceeds is required before payout.
Lower amounts remain as pending balance until threshold reached.
8.7 Seller Verification Requirement (KYC)
Prior to payout release, DKC may require identity checks (KYC) to comply with financial regulations. Failure to comply may delay payouts.
8.8 The current fee schedule is set out in the our commission guide which we may change from time to time (see clause 2). We will notify you of any change at least [ 30 days ] prior to effect.
9. Authenticity, Returns & Buyer Claims
9.1 If after sale, a Buyer claims the Item is mis-described, counterfeit, damaged or otherwise materially not as represented, we reserve the right to investigate. If the claim is upheld:
- The sale may be cancelled;
- The Net Proceeds may be reversed;
- You may be required to refund DKC for any costs incurred (returns shipping, loss of value, disposal).
- 9.2 You agree to indemnify and hold DKC harmless against any loss, damage, claim or liability arising out of your breach of these Terms (for example, authenticity or provenance issues).
- 9.3 If we determine the Item to be counterfeit or non-authentic, we may (in our discretion):
- Return the Item to you (at your cost)
- Retain the Item for disposal
- Charge you a fee for handling and shipping as described in our policies.
10. Unsold Items / Re-listing / End of Service Period
10.1 If the Item has not sold during the Service Period, DKC may (in its discretion and after notifying you):
- Reduce the price and re-list
- Offer you the option to collect the Item (at your cost)
- Donate or otherwise dispose of the Item if you do not respond within [e.g., 14 days]
- 10.2 If you wish to end consignment early, you may request return of the Item; you may be liable for storage/handling fees and return shipping.
- 10.3 Storage, insurance and handling while the Item is consigned is at our facility; you may be charged storage fees after a specified free period.
11. Termination & Removal of Items
11.1 DKC may suspend or terminate this consignment arrangement (or your account) at any time if:
- You breach these Terms;
- We suspect fraud, mis-description or non-compliance;
- You consign prohibited Items;
- You fail to respond to our communications within [ specified time ].
- 11.2 Upon termination, any unsold Items will be returned to you (at your cost) or disposed of as previously agreed; any storage or return shipping fees become your responsibility.
- 11.3 Items that are counterfeit, unsafe or in violation may be removed immediately, and you will not have any claim against DKC for removal or disposal.
12. Limitation of Liability & Indemnities
12.1 To the fullest extent permitted by law, DKC’s liability to you under or arising out of the consignment arrangement shall be limited to your Net Proceeds from the sale of the Item.
12.2 You agree to indemnify, defend and hold harmless DKC (and its officers, directors, agents, employees) from and against any claims, losses or damages (including legal fees) arising from your breach of these Terms, your mis-description, your non-compliance with laws, or any claim relating to your Item.
12.3 Nothing in these Terms excludes liability for death or personal injury caused by negligence of DKC, or for any other liability which cannot be excluded by law.
13. Governing Law & Dispute Resolution
13.1 These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England & Wales.
13.2 The parties irrevocably agree to submit to the exclusive jurisdiction of the courts of England & Wales.
14. Miscellaneous
14.1 You may not assign or transfer your rights or obligations under these Terms without DKC’s prior written consent.
14.2 If any provision of these Terms is found invalid or unenforceable, the remainder shall continue in full force and effect.
